1. Purpose

These general terms and conditions of sale (GTC) govern the contractual relations between the company Les Barquettes SASU and any natural or legal person wishing to rent a boat or book a nautical service.

2. Acceptance of the conditions

The reservation of a boat or a service implies the unconditional acceptance by the customer of these GTC.

3. Reservation and payment

- Reservation: Reservations are made online via the website lesbarquettes.com, by telephone at the contact number on the website lesbarquettes.com or by email at lesbarquettes.marseille@gmail.com

- Payment: Payment is made in full at the time of booking by credit card or any other means.

- Confirmation: A booking confirmation will be sent by email to the customer after validation of the payment.

4. Prices

The prices displayed on the website are in euros, all taxes included (TTC). They can be modified at any time without notice, but the rates applied will be those in effect at the time of booking.

5. Cancellation and modification

- Cancellation by the customer: Any cancellation must be notified by email. Cancellation fees depend on the date of notification:

- More than 30 days before the rental date: 70% refund.

- Between 15 and 30 days: 50% refund.

- Less than 15 days: no refund.

- Modification: Any modification of the reservation is possible depending on the availability of the vessels and captains and may result in additional costs.

6. Navigation conditions

- Condition of the boat: The boat is rented in good working order and must be returned in the same condition.

- License or certificate: The presence of a professional skipper on board acting as captain or skipper is mandatory for any rental or service sold by Les Barquettes SASU. The rental of a vessel where the tenant is the skipper is possible with the specific authorization of Les Barquettes SASU and if the tenant can prove certain navigation experience on the type of vessel rented. He must also have a navigation license (Coastal License at least) as well as a radio communication certificate (CRR or higher) valid for boats requiring a license.

- Use: The tenant agrees to use the boat in accordance with the regulations in force and the instructions provided by Les Barquettes SASU.

7. Insurance

The boats are covered by civil liability insurance. However, a deposit may be requested to cover any damage caused to the boat or its equipment.
Taking out professional liability insurance covering damage to property and people is mandatory for any skipper required to perform duties on the vessels (owned or under management contract) of Les Barquettes SASU

8. Liability

Les Barquettes SASU cannot be held liable for accidents, injuries or material damage occurring during the rental period, except in the event of proven fault on its part.

9. Weather conditions

In the event of poor weather conditions, Les Barquettes SASU reserves the right to cancel or postpone the rental. In this case, the customer may choose between postponing the rental or receiving a full refund.

The captain of the vessel designated for the rental is the sole decision-maker regarding the assessment of weather conditions and the cancellation of an outing.

10. Disputes

In the event of a dispute, the parties will endeavour to find an amicable solution. Failing this, the competent court will be that of the registered office of Les Barquettes SASU.

11. Complaints and customer service

For any complaints, the customer can contact customer service by email at lesbarquettes.marseille@gmailcom or by telephone at the number indicated on the site.

12. Safety conditions

The tenant must respect the safety and navigation instructions provided by Les Barquettes SASU. In the event of non-compliance, Les Barquettes SASU reserves the right to interrupt the rental without refund.

13. Special events

Events such as weddings, parties or other celebrations, filming or shooting must be declared when booking. Les Barquettes SASU reserves the right to refuse certain activities on board for security reasons.

14. Privacy policy

Customers' personal data is processed in accordance with the privacy policy available on the website lesbarquettes.com. It will only be used for the management of the reservation and commercial relations with Les Barquettes.
